Terms

These Terms are an agreement between you and SahiPost, Nashik, Maharashtra ("we", "us"). By creating an account, paying or using SahiPost you agree to them. If you use SahiPost for a business, you confirm you may accept these Terms for it, and "you" includes that business. If you don't agree, please don't use SahiPost.

Who can use SahiPost

You must be 18 or older and able to enter a binding contract under Indian law. SahiPost is built for businesses in India. Give us accurate details about yourself and your business, and keep them up to date.

What SahiPost does

SahiPost writes a social media plan for your business: a calendar of post ideas, captions and hashtags, month by month. You can also create images for your posts using artificial intelligence (AI). The plan is guidance to help you post consistently. It is not legal, tax, medical, financial or professional advice.

We can't promise any number of followers, likes, leads, sales or reach, and we don't control Instagram, Facebook, WhatsApp, Google or any other platform you post on. Their rules, and any action they take against your account, are between you and them.

Your responsibility for what you post

SahiPost never posts anything for you. You decide what to publish, and you are solely responsible for it. Before you post, check every caption, hashtag, offer, price, claim and image, and change it to fit your business. In particular, make sure that:

• every claim about your products, prices, discounts or results is true and you can back it up;
• the post follows the laws and rules that apply to your business, such as advertising, consumer protection, food safety, health, medical, financial and professional rules;
• you have the rights to any names, logos, photos, music or other material you add; and
• the post follows the rules of the platform you publish it on.

AI images and generated content

Images are made by AI from a description of your post. AI output can be wrong, unexpected, or similar to material that belongs to someone else, and the same request can give different results. We don't review images before you see them. Look at each image carefully before you use it, and don't use one that shows a real person, a brand or a logo you don't have permission to use, or that could mislead people.

Acceptable use

You agree not to use SahiPost, or anything it makes, to:

• break any law, or help anyone else break one;
• mislead or defraud people, including fake reviews, false offers, impersonation or phishing;
• create or spread hateful, harassing, violent, sexual, defamatory or obscene content, or any content involving children in a harmful way;
• infringe anyone's copyright, trademark, privacy or other rights;
• promote illegal goods or services, gambling, weapons, drugs, or anything else the law restricts without the licences it requires;
• send spam or unsolicited messages;
• try to get around the credit system, payments, rate limits or security, or get access to another person's account or data;
• copy, scrape, reverse engineer or resell SahiPost, or use it to build a competing product; or
• overload, disrupt or attack SahiPost or the services it relies on.

We may refuse a request, remove content, and suspend or close an account that breaks these rules, without notice and without a refund where the law allows. We may also report unlawful activity to the authorities and share information with them when the law requires it.

Your account

You sign in with Google. Keep your Google account secure; you are responsible for everything done through your SahiPost account. Tell us straight away at [email protected] if you think someone else has used it.

Prices and payments

Prices are in Indian rupees and are shown before you pay. You agree to the price when you pay. We may change prices at any time, but a change never affects something you have already paid for.

• Payments are processed by a licensed payment partner. We never see or store your card, UPI or bank details.
• A payment counts once our payment partner confirms it to us. If money leaves your account but the payment is not confirmed, it is normally returned to you within your bank's usual timelines.
• Where GST applies it is shown at checkout and on your invoice.
• There is no subscription and nothing renews automatically.
• You must be authorised to use the payment method you choose. A chargeback raised for a payment you did make may lead us to suspend your account.

Credits

Some features, such as AI images, are paid for with credits. One credit is worth one rupee of use on SahiPost. The cost in credits is shown before you use a feature.

• Credits can only be used on SahiPost. They have no cash value, can't be exchanged for money and can't be transferred to another account.
• If an image fails to generate, the credits for it are returned to your credit balance automatically. This returns credits only; it is not a refund of money.
• Free or bonus credits are a promotion. We may change or withdraw them, and they are used before, or instead of, paid credits as SahiPost decides.
• If an account is closed for breaking these Terms, any credits left on it are forfeited where the law allows.
• If credits are added to your account by mistake, we may correct the balance.

Refunds

Plans and credits are digital and are delivered as soon as payment is confirmed, so all payments are final and non-refundable, and orders can't be cancelled. This does not affect any right to a refund that the law gives you and that can't be excluded, such as when you are charged twice for the same order. Using the content

Once you have paid, you may use your plan's captions, ideas, hashtags and images for your own business, on your own accounts, and edit them freely. You may not resell, sublicense or republish the plan itself. Many businesses receive similar ideas and captions, so we don't give you exclusive rights to them, and AI images may not be protected by copyright at all. The SahiPost software, templates, design and brand stay ours.

You keep the rights to the details you give us about your business, and you let us use them to run SahiPost for you, as described in our Privacy policy.

Changes and availability

We may change, pause or stop any part of SahiPost. We try to keep it running, but we don't promise it will always be available, error free or secure, or that your data will never be lost, so keep your own copy of anything important.

No warranty

SahiPost, your plan and all generated content are provided "as is" and "as available". To the fullest extent the law allows, we give no warranty of any kind, whether of accuracy, quality, fitness for a purpose, results or non-infringement.

Limit of our liability

To the fullest extent the law allows:

• we are not liable for anything you or anyone else publishes, or for any loss that follows from it, including action by a platform, a regulator or a third party;
• we are not liable for any misuse of SahiPost or its content by you or anyone else;
• we are not liable for any indirect or consequential loss, or for lost profits, revenue, business, goodwill, followers or data; and
• our total liability to you for everything connected with SahiPost is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms limits liability that the law does not allow us to limit.

Indemnity

You agree to compensate us, and defend us, against any claim, penalty, loss or cost (including reasonable legal fees) that arises from content you publish, your breach of these Terms, or your breach of any law or anyone else's rights.

Ending your use

You can stop using SahiPost at any time and ask us to delete your account. We may suspend or close your account if you break these Terms, if the law requires it, or if we stop offering SahiPost. The sections on your responsibility, content, no warranty, liability, indemnity and governing law continue after that.

Changes to these Terms

We may update these Terms. We will change the date at the top, and tell you by email or on the site before a significant change takes effect. If you keep using SahiPost after that, you accept the new Terms.

Governing law and disputes

These Terms are governed by the laws of India. Please write to us first so we can try to settle any problem. Any dispute that we can't settle is subject to the exclusive jurisdiction of the courts at Nashik, Maharashtra, except where the law gives you the right to go to a consumer forum elsewhere.

General

If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. These Terms and our Privacy policy are the whole agreement between us about SahiPost.
