Fact. Both schemes are triggered by employee thresholds that small companies cross without noticing, and the obligation begins from the date the threshold is crossed rather than from the date you register.

Fact. A principal employer carries responsibility for ensuring compliance in respect of contract labour. Getting the contractor's challans and returns every month is not paperwork, it is the protection.

Both schemes are triggered by employee count thresholds, with specifics that vary by establishment type and state. The safe approach is to check the position each time headcount changes rather than annually.
Who is responsible for contract labour compliance?
The contractor has the primary obligation, but a principal employer carries responsibility for ensuring it is met. Collect challans and returns from every contractor monthly and keep them.
What is a UAN and why does it matter?
It is the universal account number that follows an employee across jobs. If it is not correctly linked and KYC verified, transfers and withdrawals stall, and it is usually discovered at the worst time.
What happens if returns are filed late?
Interest and damages apply, and they can exceed the contribution amount. They are also difficult to have waived, which is why the filing calendar matters more than the amount.
What records should we keep and for how long?
Registers, challans, returns and acknowledgements, kept month by month rather than reconstructed. Retention periods vary by record, so keep more rather than less.
What is the wage definition used for contributions?
It is not simply basic pay, and the treatment of allowances has been the subject of litigation. Getting it wrong understates contributions for years before anyone notices, so it should be reviewed rather than assumed.
Can employees opt out?
Only in limited circumstances defined by the scheme, usually relating to wage level at the time of joining and prior membership. Blanket opt-outs by agreement are not valid.
What should we do if a notice arrives?
Note the deadline, gather the records it refers to, and respond within the period. Ignoring it does not make it go away and the period stated is usually short.
